1. Acceptance of Terms
By accessing, browsing, registering on, or using any service offered through certifiedsewertechs.com (the "Platform"), you expressly agree to be bound by these Terms and Conditions ("Agreement"). This Agreement constitutes a binding private contract between you and Certified Sewer Techs (CST Network), operated under the authority of dbappsystems.com ("Operator"). If you do not agree to every term set forth herein, you must immediately cease all use of the Platform.
2. Identity of the Parties & Nature of the Agreement
2.1 The Operator
The Platform is owned and operated by dbappsystems.com, a private software development enterprise. The Operator establishes and maintains this Platform as a digital marketplace and does not perform, supervise, or warrant the quality of sewer services rendered by independent Providers.
2.2 The User
A "User" is any natural person or legal entity that accesses the Platform for the purpose of discovering, booking, or communicating with a Provider. Users affirm that they are acting on their own behalf, with full legal capacity, and under their own authority.
2.3 The Provider
A "Provider" is any licensed sewer technician, company, or independent contractor who registers on the Platform to offer services to Users. By registering, you affirm your identity, licensing status, and background clearance.
2.4 Independent Contractor Relationship
Providers listed on the CST Network are independent contractors, not employees, agents, partners, or representatives of the Operator. No employment, joint venture, or agency relationship is created by this Agreement.
3. Eligibility
To use this Platform, you must be at least 18 years of age, possess the legal authority to enter into binding agreements, not be prohibited from using the Platform under any applicable law, and provide accurate and truthful information during registration.
4. Provider Terms & Certification Standards
4.1 CST Certification
Providers must maintain CST Network standards including a valid state or local plumbing/sewer contractor license, current background check clearance, proof of liability insurance meeting minimum Platform-required coverage, and completion of any required CST Academy coursework.
4.2 Provider Conduct
Providers shall not solicit Users off-Platform to avoid Platform fees, misrepresent the scope or cost of services, engage in discriminatory or fraudulent conduct, or subcontract work without prior disclosure to the User.
5. Booking & Services
The CST Network facilitates connections between Users and Providers. The Operator is not a party to any service agreement formed between a User and a Provider. All service terms, pricing, warranties, and guarantees are solely between the User and the Provider. A booking is confirmed only upon receipt of written confirmation through the Platform.
6. Payments & Fees
Payment terms and service rates are established by individual Providers and disclosed prior to booking confirmation. The Operator may facilitate payment processing through third-party processors. Platform fees charged to Providers are non-refundable except as explicitly stated in writing by the Operator.
7. Disclaimer of Warranties
The Platform and all services facilitated through it are provided "as is" and "as available." The Operator makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Limitation of Liability
To the fullest extent permitted by applicable law, the Operator and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from use of the Platform. In no event shall the Operator's total liability to any party exceed the greater of (a) fees paid in the twelve months preceding the claim, or (b) one hundred dollars ($100.00).
9. Indemnification
You agree to indemnify, defend, and hold harmless the Operator and dbappsystems.com from and against any claims, damages, losses, costs, and expenses arising out of your use of the Platform, breach of this Agreement, any service you perform as a Provider, any content you submit, or your violation of any applicable law.
10. Governing Law & Dispute Resolution
This Agreement shall be governed by the laws of the State of Illinois. Any dispute shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, with proceedings conducted in Madison County, Illinois. You waive any right to participate in a class action lawsuit or class-wide arbitration.
11. Modifications & Termination
The Operator reserves the right to modify these Terms at any time. Continued use of the Platform following any modification constitutes your acceptance of the revised Terms. The Operator may suspend or terminate your access at any time, with or without cause.
